The present terms have the purpose of defining the General Conditions of Sale between APAC Portugal and the user, being only applicable between the two parties.
By using and/or purchasing an item on Solo Ceramic’s website, the user:
a) Declares that they’ve read and accepted these Terms and Conditions;
b) Declares that is, at least, 18 years old of age;
c) Will not make fraudulent or unfair use of this website;
d) Accepts that it will be the Portuguese legislation to regulate any conflict with the consumer, without prejudice of prevision in contrary, community directive or international treaty.
APAC Portugal reserves the right to update or modify these Terms and Conditions at any moment, without prior notice. For this reason, we advise the user to read the present Terms and Conditions whenever using this website

The prices for each item on this website are presented in euros, with VAT included at the legal rate in force, and are valid throughout the purchasing process.
These values do not include the shipping costs, which will be added to the total order costs during the checkout process (see SHIPPING COSTS below).
Solo Ceramic reserves the right to modify prices and specifications at any moment, without prior notice.
In www.soloceramic.com/en there are occasional promotions on price, through percentual discounts on the total sale price of products to the public.
All promotions are properly marked and have a predefined validation time, being valid to any orders made until the end of that same period.
DISCOUNT VOUCHERS AND GIFT CODES
Occasionally, Solo Ceramic may generate discount/gift codes during the sale process of its registered clients.
To enjoy these codes, the client must insert the respective code and/or accept the discount voucher by clicking “Validate”.
The discount will be applied in the “Total to pay”, at checkout.
The Solo Ceramic website accepts as payment mechanisms: ATM reference, Credit Card (Visa, Mastercard), MBWay and Paypal.
For payments through ATM reference, the client has 2 days (48 hours) to process the payment, it being immediate to the transaction. At the end of this period, if no payment has been made, the order will be cancelled.
For credit card payments, the debit will be processed immediately after the checkout.
All online shopping in the website www.soloceramic.com/en can be delivered solely to Continental Portugal.
The dispatchment of our orders are only processed by our servers after confirmation of the respective payment.
The orders are dispatched by a specialised delivery company.
These will be shipped to the address provided by the client, which can’t be altered. In the case of wrong information given by the client and/or change in address it is of the client’s responsibility to support any additional costs.
If the client wishes to send an order to more than one address, they should do so in separate buying processes.
In that case, each order has its own delivery costs.
Solo Ceramic’s delivery orders take between 3 and 5 weekdays.

Solo Ceramic tries its best to deliver all orders on the above mentioned deadlines, however these may be slightly extended during the holidays.
Please note that when the client does not open the door to the delivery person, the order will be left in the nearest post office, and it’s the customer’s responsibility to pick it up.
All products presented in the Solo Ceramic website are limited to the existing stocks.
In case of unavailability of an already ordered product, Solo Ceramic commits to inform the client about the new delivery date forecast, being that the client can maintain or cancel the order.
If the client chooses to cancel the order, Solo Ceramic will refund the total payed amount (through the same payment method used by the customer), in a period of 30 days after the date of the announcement of unavailability by Solo Ceramic to the client.
In the case of being interested in a product from a previous collection, no longer available in-store, please contact us through the contact form.
After payment verification and, in a maximum of 24 hours, a confirmation email will be sent to the client, followed by a text message, once the order leaves the distribution centre. A tracking number will be provided to the customer, which he can use to track the delivery status in the distributor company’s website.
For verification purposes, distributors may ask for the client’s signature (or a representative) when delivering the product.
It’s possible to cancel orders as long as they have not yet been processed by Solo Ceramic and in the legal period of 14 days. Cancelling an order guarantees the money back to the client by the same payment mechanism used, however shipping costs are of the client’s responsibility.
The client may cancel an order by sending an email to firstname.lastname@example.org, with the subject “Cancel order”, or through our contact form.
It is mandatory that the client presents the order’s reference in the body of the message.
Registered clients are able to cancel orders on “My Account”.
We accept exchanges and returns, until up to 15 days after order delivery, in the following conditions:
a) The acquired product does not satisfy the needs of the client*;
b) The product is not the one ordered by the client;
c) Product defect;
d) Product damage.
The return must be requested by the client with an email to email@example.com, with the subject “Return”, or through the contact form.
The client must write in the body of the message the reasons for the return and the reference of the order in question. Returns without previous warning will not be accepted.
For registered clients, returns can be managed in “My Account“.
The return must be made through our hired distribution company and its pick up is in the pointed address, usually on the following weekday.
In the mentioned conditions (except point a), Solo Ceramic takes in all costs related with the return, including the shipping costs of the new article if the client decides to make an exchange.
The repayment will be processed after evaluation of the product(s), through the same payment method used in the initial transaction, until up to 30 days after the return.
The returned products must be in the same conditions as in arrival and accompanied with the respective proof of purchase.
Products that have been used, transformed, damaged or without packaging will not be accepted.
* Return costs are of the client’s responsibility.
Solo Ceramic recognises the importance of protecting personal data given by the user. As such, it has developed a group of security actions that aim at data protection and its treatment according to the General Data Protection Regulation.
The user of the website www.soloceramic.com/en, by signing in or buying online, explicitly guarantees to Solo Ceramic their consent in the usage of their personal data, address, data related to their buying process and payment mechanisms.
The data given by the user will be saved and treated in the same way, and may be utilised for commercial ends, namely for the processing of orders, communication of offers, of products, of services, promotional campaigns or advertising campaigns.
The Treatment of Personal Data is made accordingly to the legislation of personal data protection, all in terms of the General Data Protection Regulation (EU) 2016/679 and/or any other legislation that may regulate, add or substitute the before mentioned legislation.
Users with ages bellow 18 years old, to whom it was not given previous autorisation by a parent or tutor, must not send any personal information through the Website.
Solo Ceramic assumes that the user is able to supply the data collected through the Website and that it is actual, true and precise.
Solo Ceramic is responsible for the management and content of the Website, whose domain is owned by APAC Portugal, and by the treatment off users’ personal data collected by the Website.
Treated Data, their use and the ends for their treatment
In the context of the use of the Website by the user, Solo Ceramic may treat the following categories of data, for the forward mentioned ends:
(1) Data collected through forms on the Website
The fill-in of Website forms by the user (for example to subscribe to the newsletter of to a campaign) implies the collection of personal data requested in the scope of the form. The subscription to Solo Ceramic’s information and the fill-in of certain forms implies the sending of informative messages by post or phone number by Solo Ceramic to the user. Occasionally, these messages may be request some information that allows Solo Ceramic to get to know generically characteristics of its users. The users can, at any moment, unsubscribe to the campaign or newsletter that they have previously subscribed to.
(2) Data collected to purchases or website services
The personal data that the user provides once they register as client, are used to: identify them as user of the Website and give them access to the functionalities, products and services available at sign in as user;
Preparation, compliance and execution of the contract of purchase and sale respective to the acquired products or any other contract that may be made through the Website;
To personalise the services that motivate the purchase of products in the Website, in the case that intention to buy is showed by adding products to the wish list;
Contact by email or by another equivalent way of eletronic communication, concerning products or services, functions of the Website and any on-going contracts;
Answer and manage requests of the user through client service channels, as well as to obtain information regarding the quality of the service.
(3) Use statistics
Personal data may also be used by AI, in a aggregated and anonymised way, for statistical reasons and the up-keep of trends and definition of patterns of utilisation of the Website, as to improve the performance of the latter.
With whom is the personal data shared
Within the framework of its competencies, Solo Ceramic needs to share users’ personal information to third parties, as such the user recognizes and consents with this sharing. In this scope, Solo Ceramic may send this data:
a) To the administrative or judicial authority, namely when Solo Ceramic is forced to that by law or by judicial order or by administrative nature, as long as issued by a qualified entity;
b) To A subcontracted third parties by APAC Portugal, if it seems reasonable to investigate, prevent or take measures against illegal or inappropriate activities, fraud suspicions or potential threats to Solo Ceramic/APAC Portugal, for the users of the Website, or violations or suspicions of violation of the Terms and Conditions of the Website.
Right of Access, Rectification and Data Update
Under the law, Solo Ceramic guarantees, at all times, the right of access, rectification, update and erasing of the user’s personal data. Furthermore, the user can opt-out of their data treatment for direct marketing. In all cases, the user must make a written request to Solo Ceramic (responsible for the treatment) by sending an email to firstname.lastname@example.org.

The collected data is archived in an automatised and confidential file. Solo Ceramic has technical and organisational procedures in order to prevent breaches of security and improper access to personal data, its respective destruction or illegal use, as well as guarantees to employ any other security measures required by the Data Protection Law.
However, despite all efforts, Solo Ceramic can not guarantee the complete and absolute and inviolability of the information received, taking into account the insecure nature of open networks such as the Internet.
